Tribunal Preparation

Preparation is everything when it comes to tribunals. You need to make sure you're fully read up on the case, witnesses are prepared and all bases are covered.

Without an understanding of Employment Law and a solid argument that's based on evidence and case law, many Tribunal cases will fail.

There’s no doubt that dealing with a tribunal claim is one of the most stressful situations an employer will have to deal with. From start to finish it’s time consuming, a headache of red tape and legal jargon and takes you away from the day to day running of your business.

The main part of the preparation for tribunal cases is preparing a pack or a bundle. A bundle is a full rundown of the case from start to tribunal including documents and communications in an organised and chronological order for a tribunal to digest. It is agreed between both parties, and all documentation is shared beforehand. This needs to be done in an organised and efficient manner, within the 28-day window as set out by the tribunal service.

During this process it’s important to gather witness statements, brief witnesses and prepare them for the tribunal hearing. Not everyone is confident under pressure so may need some coaching beforehand to make sure when the date arrives that everyone is ready, confident and as stress-free as possible.

The aim of a preliminary hearing is to allow the judge to understand a case better; should it be particularly complicated and often in cases of discrimination. The preliminary hearings provide a good opportunity aside from conciliation to attempt to resolve the case but should that fail they’re used to agree timescales and documentation to include as part of the pack.
